IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

6. Indemnification

You agree to fully defend, indemnify, and hold harmless OnlyThirst, its officers, directors, employees, contractors, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising directly or indirectly from: (a) your use of and access to the Service; (b) your violation of any term of these Terms of Service; (c) your violation of any third-party right, including without limitation any copyright, trademark, property, or privacy right; or (d) any claim that your submitted content caused damage to a third party.

7. Governing Law, Binding Arbitration, and Class Action Waiver

A. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates, without regard to its conflict of law provisions.
B. Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by binding arbitration administered by a recognized arbitration association, rather than in court. The decision of the arbitrator shall be final and binding.
C. Class Action Waiver: You and OnlyThirst agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive any right to file a class action or seek relief on a class basis.

8. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court or arbitrator, the remaining provisions of these Terms will remain in full force and effect. These Terms constitute the entire agreement between us regarding our Service.
